, the supreme court has notify the us it will take us gay marriage cases including california's ban on same-sex marriage unions. we got the word and our correspondent is with us on the phone now. shannon, what is the story? >>shannon: they decided to take up to different gay marriage cases. you mention the one from california, you may remember proposition eight. the voters passed a measure that allows only the recognition of one man, one woman as a "marriage." a federal court overturned that. that want on appeal to the supreme court and they decided they will weigh in on that fight. in addition there were eight cases on the diagnosis -- the docket on the defense of marriage act and a portion only recognizes marriage as between a man and a woman and has been challenged dozens of times. they agreed to take up a case dealing with defense of marriage act. two different cases but both going to the same issues. they are different on technical and legal points but the bottom line is the same and the court has told us it will hear two gay marriage cases and we expect the earliest to get on the cale

. >>> in california, a law that mainstream mental health groups and equal rights advocates have held as a milestone is under attack tonight. the law bans so-called conversion therapy or reparative therapy, a so-called treatment that claims to turn gay children and teenagers straight. california's ban was scheduled to take effect january 1st but in the last 48 hours, two federal judges have issued opposing rulings in separate lawsuits challenging the ban. one judge ruled that three plaintiffs will be able to continue offering the therapy until their trial is over. the other judge denied an injunction to a separate set of plaintiffs. both lawsuits, it's confusing, but both lawsuits claim that banning the so-called therapy violates therapists' first amendment rights. keep in mind, nearly all mainstream medical and psychological associations say there's no solid evidence that any of these therapies work, while they also say they may be damaging. we're talking about kids, teenagers who often don't choose this therapy for themselves. it's often chosen by their parents. dr. drew pinsky has pretty strong t

, found it unconstitutional. and, at the state level, in california and i think the court will be modest and cautious. i think the court has learned, especially the justice john roberts court, is weary of doing what the court dade in roe vs. wade in 1973 and i don't think they will throw out arrangements in 30 states and 40 states, and they will resolve, i suspect the defense of marriage act case narrowly, only one section is actually an issue, section 3, in california they'll make a decision that might uphold the appellate court and keep it limited to california and i believe the court doesn't want to be, you know, overturning arrangements, throughout the country, something so delicate as this. they learned the lesson that that is not the right role for the supreme court. >> chris: let's talk about that. a lot of people make the comparison, to 1973. roe vs. wade. because, what is so interesting is that, public attitudes on same sex marriage changed dramatically. let's put up the map. 37 states, either by law or in their excuses, now ban same sex marriages, but, they are legal in 9 state
